Default Kibbie has a copy write question

Kibby wants to make a t shirt for her self based on a book that is coming out as a movie. The Hunger Games. She wants to use a symbol from the book. If she is making the t shirt for herself only is she breaking copy write laws.

Firstly, for your (and her) reference, it's copyright - as it's about the right to make copies.

Secondly, if she is making it just for herself, and re-creating the symbol herself rather than actually using a direct scan of the symbol from the book, then you should be okay.

what I want to do is take a pictur that is online and use it on the top part of the shirt or bag and on the bottom use the saying from the book .

the saying is

my the odds ever be in your favor

Um...strictly speaking, yes, you would be violating their trademark if you're using their logo (and possibly a trademarked slogan) and if you're taking someone's image you're violating the copyright on that individual picture.

Are they likely to come after you if you're not selling it? *Probably* not. Would they be within their rights to do so? Yes. You're copying an image you don't own and using it on a product--if it were just a book, they probably would not be likely to bother about it, but as it's a movie and movies are all about the merchandising, IF someone saw it (at a con, for example), yes, you could get a Cease and Desist letter.

Copyright and trademark don't really care if you're making a profit or not. Fair use doesn't cover "I just wanted it for me." If you're talking about, say, hand-painting it, or creating a counted cross-stitch or something, that could arguably be considered fan art and a lot of trademark owners will let it slide if you're not making money off it. If you're just copy/pasting a photo from the internet and printing it on a transfer you stick on a t-shirt, that's not really art, just logo-stealing to create a product they'd rather you buy (and with a movie they'll be selling them.)

What Anareth said. It would be a copyright violation as you're copying the artwork directly, but you are unlikely to actually face any consequences.

Creating your own version of it could be argued as being sufficiently transformative as to not be a violation.
